INTRODUCTION: In recent years the EU has been active in developing a common
European immigration policy in cooperation with third countries and in
building an “external dimension” of such an EU policy. The linkages between
the EU’s external relations and migration policies have influenced the
distinct legal positions of third-country nationals (non-EU nationals). This
book critically discusses whether the EU’s objective of creating a common EU
migration policy can be achieved against the backdrop of a highly fragmented
EU framework for migration law and policy, and it argues that it is difficult
to speak of one single, unitary group of third-country nationals forming the
counterpart to EU citizens.

INTRODUCTION: The embrace of socio-economic rights in South Africa has

INTRODUCTION: The Charter of Fundamental Rights of the European Union
enshrines the key political, social and economic rights of EU citizens and
residents in EU law. In its present form it was approved in 2000 by the
European Parliament, the Council of Ministers and the European Commission.
However its legal status remained uncertain until the entry into force of the
Treaty of Lisbon in December 2009. The Charter obliges the EU to act and
legislate consistently with the Charter, and enables the EU's courts to strike
down EU legislation which contravenes it. The Charter applies to EU Member
States when they are implementing EU law but does not extend the competences
of the EU beyond the competences given to it in the treaties. This Commentary
on the Charter, the first in English, written by experts from several EU
Member States, provides an authoritative but succinct statement of how the
Charter impacts upon EU, domestic and international law. Following the
conventional article-by-article approach, each commentator offers an expert
view of how each article is either already being interpreted in the courts, or
is likely to be interpreted. Each commentary is referenced to the case law and
is augmented with extensive references to further reading. Six cross-cutting
introductory chapters explain the Charter's institutional anchorage, its
relationship to the Fundamental Rights Agency, its interaction with other
parts of international human rights law, the enforcement mechanisms,
extraterritorial scope, and the all-important 'Explanations'.

INTRODUCTION: The human rights enunciated in Articles 23 and 24 of the UDHR
concern aspects of rights related to work. This part of international human
rights law is often neglected in human rights textbooks and teaching, and
indeed is often omitted from the work done by national human rights institutes
and by NGOs concerned with human rights, as though it were a separate
discipline that did not fall properly into the human rights field. This volume
addresses this commonly held, but erroneous, misconception. There are aspects
of labor-related rights in all the major human rights instruments and systems.
While the International Labor Organization (ILO) is the primary body in this
field, labor-related rights are also dealt with by the United Nations, the
major regional organizations (such as the OAS and the EU), and the development
banks (the World Bank and its regional counterparts). There are also
provisions on labor rights in all the major international instruments, or they
have been read to cover labor-related questions. This volume, which reviews
the development and implementation of Articles 23 and 24 of the UDHR, will
spend most attention on the ILO, which is the premiere organization in this
field, both chronologically and substantively. However, since a thorough and
complete picture of human rights cannot be drawn without considering
labor-related rights as an aspect of the broader human rights canon, the rest
of the international system will also be brought in.
This book is the
fifth volume in The Universal Declaration of Human Rights Series. The Series
will consist of approximately 20 volumes, each dealing with a substantive
right (or group of rights) set forth in the Universal Declaration of Human
Rights (UDHR). Each volume is authored by an expert in human rights generally
and in the particular subject addressed. Without losing sight of the political
context in which the implementation of human rights must occur, each book
provides a comprehensive, legally-oriented analysis of the rights concerned,
including an examination of the legislative history of the text of each right
as adopted in 1948, the right's subsequent articulation and interpretation by

INTRODUCTION: The accession by the European Union to the European
Convention on Human Rights (ECHR) has opened up new possibilities in terms of
the constitutional recognition of fundamental rights in the EU. In the field
of employment law it heralds a new procedure for workers and trade unions to
challenge EU law against the background of the ECHR. In theoretical terms this
means that EU law now goes beyond recognition of fundamental rights as mere
general principles of EU law, making the ECHR the 'gold standard' for
fundamental (social) rights.
This publication of the Transnational
Trade Union Rights Working Group focuses on the EU and the interplay between
the Strasbourg case law and the case law of the Court of Justice of the
European Union (CJEU), analysing the relevance of the ECHR for the protection
of workers' rights and for the effective enjoyment of civil and political
rights in the employment relation. Each chapter is written by a prominent
European human rights expert and analyses the case law of the European Court

standards within the Council of Europe (in particular the (Revised) European
Social Charter), the International Labour Organization (ILO) (in particular
the fundamental rights conventions) and the UN Covenants (in particular the
International Covenant on Economic, Social and Cultural Rights) and the
interpretation of these instruments by competent organs.
The authors
also analyse the ways in which the CJEU has acknowledged the respective ECHR
articles as 'general principles' of EU law and asks whether the Lisbon Treaty

INTRODUCTION: Description:.
The system of the European Convention of
Human Rights imposes positive obligations on the state to guarantee human
rights in circumstances where state agents dot not directly interfere. In
addition to the traditional/liberal negative obligation of non-interference,
the state must actively protect the human rights of individuals residing
within its jurisdiction. The liability of the state in terms of positive
obligations induces a freestanding imperative of human rights that changes
fundamentally the perception of the role of the state and the participatory
ability of the individual, who can now assert their human rights in all
circumstances in which they are relevant. In that regard, positive obligations
herald the most advanced review of the state’s business ever attempted in
international law.
The book undertakes a comprehensive study of
positive obligations: from establishing the legitimacy of positive obligations
within the system of the Convention to their practical implementation at the
national level. Analysing in depth legal principles that pervade the whole
system of the Convention, a coherent methodological framework of critical
stages and parameters is provided to determine the content of positive
obligations in a consistent, predictable and realistic manner.
This
study of the Convention explains and critically analyses the state’s positive
obligations, as imposed by the European Court of Human Rights, and sets out
original proposals for their future development. The book will be of interest
to those who study, research or practice public law, civil rights and
liberties or international/European human rights law.

shifts. How do we explain how equal treatment can in effect lead to
inequality, while unequal treatment might be necessary in order to achieve
equality? The apparent paradox can be understood if we accept that equality
can be formulated in different ways, depending on which underlying conception
is chosen. In this highly readable yet challenging book, Sandra Fredman
examines the ways in which discrimination law addresses these questions.
The new edition retains the format of the highly successful first
edition, while incorporating the many new developments in discrimination law
since 2002, including the Equality Act 2010, human rights law, and EU law. By
using a thematic approach, the book illuminates the major issues in
discrimination law, while at the same time imparting a detailed understanding
of the legal provisions. The comparative approach is particularly helpful; by
examining comparable law in the US, India, Canada, and South Africa, as well
as the UK, the book exposes common problems and canvasses differing solutions.
As in the previous edition, the book locates discrimination in its wider
social and historical context. Drawing on the author's wide experience of
equality law in many jurisdictions, she creates an analytic framework to
assess the substantive law.
The book is a thought-provoking and
accessible overview of the way in which equality law has adjusted to new and
increasingly complex challenges. It concludes that progress has been evident,
but uneven. Those dedicated to equality still face an exacting, but ultimately

INTRODUCTION: Abstract:.
Focusing on seasonal agricultural migrant
workers in Canada, this article illustrates how local migrant rights activists
have utilized different judicial fora to claim rights for non-citizen migrant
workers under the international human rights framework. The article
underscores the role of litigation by activists who, citing international
norms and conventions, claim that protections provided by domestic
constitutional provisions and labor laws should be extended to non-citizen
migrants. The importance of judges' willingness to recognize the international
law framework is also underscored. This article contributes to human rights
studies by emphasizing the transformative role of judicial agency in the fight
for the extension of human rights protections.
Relative to citizens,
non-citizens are a group lacking in political power and as such vulnerable to
having their interests overlooked and their rights to equal concern and
respect violated.

INTRODUCTION: Concerns associated with globalisation of markets,
exacerbated by the 'credit crunch', have placed pressure on many nation states
to make their labour markets more 'flexible'. In so doing, many states have
sought to reduce labour standards and to diminish the influence of trade
unions as the advocates of such standards. One response to this development,
both nationally and internationally, has been to emphasise that workers'
rights are fundamental human rights. This collection of essays examines
whether this is an appropriate or effective strategy.
The book begins
by considering the translation of human rights discourse into labour
standards, namely how theory might be put into practice. The remainder of the
book tests hypotheses posited in the first chapter and is divided into three
parts. The first part investigates, through a number of national case studies,
how, in practice, workers' rights are treated as human rights in the domestic
legal context. These ten chapters cover African, American, Asian, European,
and Pacific countries. The second part consists of essays which analyse the
operation of regional or international systems for human rights promotion, and
their particular relevance to the treatment of workers' rights as human
rights. The final part consists of chapters which explore regulatory
alternatives to the traditional use of human rights law. The book concludes by
considering the merits of various regulatory approaches.

INTRODUCTION: This book revisits, in a new light, some of the classic cases
which constitute the foundations of the EU legal order and is timed to
celebrate the 50th anniversary of the Rome Treaty establishing a European
Economic Community. Its broader purpose, however, is to discuss the future of
the EU legal order by examining, from a variety of different perspectives, the
most important judgments of the ECJ which established the foundations of the
EU legal order. The tone is neither necessarily celebratory nor critical, but
relies on the viewpoint of the distinguished line-up of contributors - drawn
from among former and current members of the Court (the view from within),
scholars from other disciplines or lawyers from other legal orders (the view
from outside), and two different generations of EU legal scholars (the

INTRODUCTION: This volume offers a lawyer’s view on the meaning of
fundamental social rights in today’s Europe. It is published on the occasion
of the 10th anniversary of the EWL and reflects the research efforts the
members of the European Working Group on Labour Law have made in its 10 years
of existence.
The recognition of fundamental social rights offers
opportunities for valuing the meaning of the fundamental social rights for
workers aiming at actually benefiting from these. The non-discrimination norm,
since it has been long and widely recognised in EU law, is the most striking
example. It has served as a catalyst for all Member States. Apart from that,
the fundamental social rights as generally recognised by international
organisations are also challenged in EU law. This is not only because the EU
law does not explicitly grant protection to workers since some of these
fundamental social rights are not covered by it, but also due to a potential
collision between these rights and the fundamental freedoms of the European
Community. The recent cases of Viking, Laval and Rüffert appear to deliver
conclusive proof of the potential subordination of the fundamental social
rights to the fundamental freedoms of the EC.
In this volume, experts
in the field of European labour law, deal with the opportunities EU law is
offering and how it is fitting into the social policy of the European Union,
as well as with potential threats to an effective application of the
fundamental social rights. Some of the contributions refer to the cases of
Viking, Laval and Rüffert as to their impact on the right to collective action
as well as its meaning for the establishment of decent employment conditions,
and in particular the right to a decent wage which is one of the ‘oldest’
fundamental social rights. Another crucial issue that is touched upon in this
volume is the right to work and the right of protection for workers. The
objective that is advocated in the EU as a cornerstone of modern social policy
is the combination of flexibility and security, in one word: flexicurity,
which has been analysed in terms of contributing to or jeopardising the
position of the employee. It is the supposed dilemma of the protection of the
‘haves’ at the expense of the ‘have nots’, ‘insiders versus outsiders’. A
third topic is the fundamental right connected to the freedom of association.
A problem that has recently raised a lot of discussion and legislative
proposals is whether sufficient representativeness of trade unions is required
in order to be legitimised for collective bargaining and the conclusion of
binding collective agreements. Linked to this is the effective recognition of
the right of participation for workers and their representatives at enterprise
level: the right to information and consultation, its scope and its effect.
What these contributions have in common is the question whether
European law has to play a harmonising or only a facilitating role. Can or
must the European Union contribute to the upgrading of the meaning and the
impact of fundamental social rights in the labour law of the EU and its Member
States, and if so, to what extent and in which way?

Where that first
volume looked at the emerging market for use of force, this second volume
looks at the transformations in the nature of state authority. Drawing on
insights from work on privatization, regulation, and accountability in the
emerging field of global administrative law, the book examines private
military and security companies through the wider lens of private actors
performing public functions. In the past two decades, the responsibilities
delegated to such actors - especially but not only in the United States - have
grown exponentially. The central question of this volume is whether there
should be any limits on government capacity to outsource traditionally
"public" functions. Can and should a government put out to private tender the
fulfilment of military, intelligence, and prison services? Can and should it
transfer control of utilities essential to life, such as the supply of water?
This discussion incorporates numerous perspectives on regulatory and
governance issues in the private provision of public functions, but focuses
primarily on private actors offering services that impact the fundamental
rights of the affected population.
