INTRODUCTION: In recent years the EU has been active in developing a common European immigration policy in cooperation with third countries and in building an “external dimension” of such an EU policy. The linkages between the EU’s external relations and migration policies have influenced the distinct legal positions of third-country nationals (non-EU nationals). This book critically discusses whether the EU’s objective of creating a common EU migration policy can be achieved against the backdrop of a highly fragmented EU framework for migration law and policy, and it argues that it is difficult to speak of one single, unitary group of third-country nationals forming the counterpart to EU citizens.

INTRODUCTION: The embrace of socio-economic rights in South Africa has featured prominently in scholarship on constitution making, legal jurisprudence, and social mobilization. But the development has attracted critics who claim that this turn to rights has not generated social transformation in practice. This book sets out to assess one part of the puzzle and asks what has been the role and impact of socio-economic strategies used by civil society actors. Focusing on a range of socio-economic rights and national trends in law and political economy, the book's authors show how socio-economic rights have influenced the development of civil society discourse and action. The evidence suggests that some strategies have achieved material and political impact but this is conditional on the nature of the claim, degree of mobilization and alliance building, and underlying constraints.

First comprehensive study of the effects of socio-economic strategies in South Africa.

Gives a diverse picture of post-apartheid social mobilisation.

Provides numerous case studies and new evidence on impact and strategies.

The EU charter of fundamental rights : a commentary / Peers, Steve ... [et al.], xlii, 1893 p.. - Oxford : Hart, 2014.

INTRODUCTION: The Charter of Fundamental Rights of the European Union enshrines the key political, social and economic rights of EU citizens and residents in EU law. In its present form it was approved in 2000 by the European Parliament, the Council of Ministers and the European Commission. However its legal status remained uncertain until the entry into force of the Treaty of Lisbon in December 2009. The Charter obliges the EU to act and legislate consistently with the Charter, and enables the EU's courts to strike down EU legislation which contravenes it. The Charter applies to EU Member States when they are implementing EU law but does not extend the competences of the EU beyond the competences given to it in the treaties. This Commentary on the Charter, the first in English, written by experts from several EU Member States, provides an authoritative but succinct statement of how the Charter impacts upon EU, domestic and international law. Following the conventional article-by-article approach, each commentator offers an expert view of how each article is either already being interpreted in the courts, or is likely to be interpreted. Each commentary is referenced to the case law and is augmented with extensive references to further reading. Six cross-cutting introductory chapters explain the Charter's institutional anchorage, its relationship to the Fundamental Rights Agency, its interaction with other parts of international human rights law, the enforcement mechanisms, extraterritorial scope, and the all-important 'Explanations'.

INTRODUCTION: The human rights enunciated in Articles 23 and 24 of the UDHR concern aspects of rights related to work. This part of international human rights law is often neglected in human rights textbooks and teaching, and indeed is often omitted from the work done by national human rights institutes and by NGOs concerned with human rights, as though it were a separate discipline that did not fall properly into the human rights field. This volume addresses this commonly held, but erroneous, misconception. There are aspects of labor-related rights in all the major human rights instruments and systems. While the International Labor Organization (ILO) is the primary body in this field, labor-related rights are also dealt with by the United Nations, the major regional organizations (such as the OAS and the EU), and the development banks (the World Bank and its regional counterparts). There are also provisions on labor rights in all the major international instruments, or they have been read to cover labor-related questions. This volume, which reviews the development and implementation of Articles 23 and 24 of the UDHR, will spend most attention on the ILO, which is the premiere organization in this field, both chronologically and substantively. However, since a thorough and complete picture of human rights cannot be drawn without considering labor-related rights as an aspect of the broader human rights canon, the rest of the international system will also be brought in.

This book is the fifth volume in The Universal Declaration of Human Rights Series. The Series will consist of approximately 20 volumes, each dealing with a substantive right (or group of rights) set forth in the Universal Declaration of Human Rights (UDHR). Each volume is authored by an expert in human rights generally and in the particular subject addressed. Without losing sight of the political context in which the implementation of human rights must occur, each book provides a comprehensive, legally-oriented analysis of the rights concerned, including an examination of the legislative history of the text of each right as adopted in 1948, the right's subsequent articulation and interpretation by international bodies and in subsequent international instruments, and a survey of state practice in defining and enforcing the right.

INTRODUCTION: The accession by the European Union to the European Convention on Human Rights (ECHR) has opened up new possibilities in terms of the constitutional recognition of fundamental rights in the EU. In the field of employment law it heralds a new procedure for workers and trade unions to challenge EU law against the background of the ECHR. In theoretical terms this means that EU law now goes beyond recognition of fundamental rights as mere general principles of EU law, making the ECHR the 'gold standard' for fundamental (social) rights.

This publication of the Transnational Trade Union Rights Working Group focuses on the EU and the interplay between the Strasbourg case law and the case law of the Court of Justice of the European Union (CJEU), analysing the relevance of the ECHR for the protection of workers' rights and for the effective enjoyment of civil and political rights in the employment relation. Each chapter is written by a prominent European human rights expert and analyses the case law of the European Court of Human Rights (ECtHR), and also looks at the equivalent international labour standards within the Council of Europe (in particular the (Revised) European Social Charter), the International Labour Organization (ILO) (in particular the fundamental rights conventions) and the UN Covenants (in particular the International Covenant on Economic, Social and Cultural Rights) and the interpretation of these instruments by competent organs.

The authors also analyse the ways in which the CJEU has acknowledged the respective ECHR articles as 'general principles' of EU law and asks whether the Lisbon Treaty will also warrant a reassessment of the way it has treated conflicts between these 'general principles' and the so-called 'fundamental freedoms'.

INTRODUCTION: Description:.

The system of the European Convention of Human Rights imposes positive obligations on the state to guarantee human rights in circumstances where state agents dot not directly interfere. In addition to the traditional/liberal negative obligation of non-interference, the state must actively protect the human rights of individuals residing within its jurisdiction. The liability of the state in terms of positive obligations induces a freestanding imperative of human rights that changes fundamentally the perception of the role of the state and the participatory ability of the individual, who can now assert their human rights in all circumstances in which they are relevant. In that regard, positive obligations herald the most advanced review of the state’s business ever attempted in international law.

The book undertakes a comprehensive study of positive obligations: from establishing the legitimacy of positive obligations within the system of the Convention to their practical implementation at the national level. Analysing in depth legal principles that pervade the whole system of the Convention, a coherent methodological framework of critical stages and parameters is provided to determine the content of positive obligations in a consistent, predictable and realistic manner.

This study of the Convention explains and critically analyses the state’s positive obligations, as imposed by the European Court of Human Rights, and sets out original proposals for their future development. The book will be of interest to those who study, research or practice public law, civil rights and liberties or international/European human rights law.

INTRODUCTION: The immunity or exemption enjoyed by States from legal proceedings before foreign national courts is a crucial area of international law. On the basis of an exhaustive analysis of judicial decisions, international treaties, national legislation, government statements, deliberations in international organisations as well as scholarly opinion, Xiaodong Yang traces the historical development of the relevant doctrine and practice, critically analyses the rationale for restrictive immunity and closely inspects such important exceptions to immunity as commercial transactions, contracts of employment, tortious liability, separate entities, the enforcement of judgments, waiver of immunity and the interplay between State immunity and human rights. The book draws a full picture of the law of State immunity as it currently stands and endeavours to provide useful information and guidance for practitioners, academics and students alike.

INTRODUCTION: Human Rights in Asia focuses on the relationships between political regimes, institutions and cultures, and external actors, such as international organisations, NGOs and business. The contributing authors provide important discussions on Burma, Cambodia, China, India, Indonesia, Malaysia, Singapore, Thailand and the Philippines. Thematic chapters then go on to frame these individually focused contributions, by examining the international pressure to ‘normalise’ rights regimes, and the relationship between Islam and rights in the region.

Providing a unique combination of country-specific and thematic analysis, this book will be a fascinating and beneficial read for postgraduate and undergraduate students in human rights and international relations, as well as for scholars in politics, human rights, international relations and government and NGO analysts.

INTRODUCTION: Provides a broad introduction to all major spheres of discrimination law.

Explores the wider social, historical, and legal context of discrimination law.

Takes a firm stance on discrimination law issues, outlining the author's influential opinion of the field.

Comparative study explores common themes and discusses different approaches to solving these problems in a variety of jurisdictions, including the US, India, Canada, South Africa, UK, EU, and ECH.

New to this edition:.

Incorporates the many new developments in discrimination law since 2002, including the Equality Act 2010, human rights law, and EU law.

Expanded coverage of the 'new' strands in discri mination law, including discrimination on grounds of sexual orientation, age, and religion and belief.

discrimination on grounds of sexual orientation, age, and religion and belief * Extensive comparative coverage including the US, India, Canada, and South Africa, as well as the UK, EU, and ECHR.

Equality is an ideal to which we all aspire. Yet the more closely we examine it, the more its meaning shifts. How do we explain how equal treatment can in effect lead to inequality, while unequal treatment might be necessary in order to achieve equality? The apparent paradox can be understood if we accept that equality can be formulated in different ways, depending on which underlying conception is chosen. In this highly readable yet challenging book, Sandra Fredman examines the ways in which discrimination law addresses these questions.

The new edition retains the format of the highly successful first edition, while incorporating the many new developments in discrimination law since 2002, including the Equality Act 2010, human rights law, and EU law. By using a thematic approach, the book illuminates the major issues in discrimination law, while at the same time imparting a detailed understanding of the legal provisions. The comparative approach is particularly helpful; by examining comparable law in the US, India, Canada, and South Africa, as well as the UK, the book exposes common problems and canvasses differing solutions. As in the previous edition, the book locates discrimination in its wider social and historical context. Drawing on the author's wide experience of equality law in many jurisdictions, she creates an analytic framework to assess the substantive law.

The book is a thought-provoking and accessible overview of the way in which equality law has adjusted to new and increasingly complex challenges. It concludes that progress has been evident, but uneven. Those dedicated to equality still face an exacting, but ultimately deeply rewarding, task.

ABSTRACT: CONTENTS:.

1: Equality: Concepts and Controversies. 2: Social Context and Legal Developments. 3: The Scope of Discrimination law. 4: Legal Concepts: Direct, Indirect Discrimination, and Beyond. 5: Symmetry Or Substance: Reverse Discrimination. 6: Rights and Remedies: the Limits of the Law.

INTRODUCTION: Having often been framed in terms of security concerns, migration issues have simultaneously given rise to issues of insecurity: on the one hand, security of borders, political, societal and economic security/insecurity in the host country; on the other, social, legal and economic concerns about human security, with regard to both EU citizens and migrants entering Europe. In terms of state security, migration is a core target of increasingly globally networked surveillance capabilities, whilst with respect to human security, it exposes the gap between the protections that migrants formally enjoy under international law and the realities they experience as they travel and work across different countries. Drawing on the latest research from across the EU, Security, Insecurity and Migration explores the concerns of states with regard to migration and the need to protect the fundamental rights of migrants. An interdisciplinary examination of the issues of security and insecurity raised by migration for states, their citizens and migrants themselves, this book will be of interest to scholars of politics, sociology and geography researching migration, race and ethnicity, human and state security and EU politics and policy.

INTRODUCTION: This collection of essays explores the notion, tools and challenges of human rights diplomacy, which is understood as the utilisation of diplomatic negotiation and persuasion for the specific purpose of promoting and protecting human rights. Theoretical reflections are combined with first-hand accounts from a range of policy-makers involved in human rights diplomacy at the bilateral, regional and multilateral (UN) level. Contributors include inter-governmentally appointed office-holders, human rights ambassadors, members of UN human rights treaty bodies and representatives of inter-… read moregovernmental organisations, national human rights organisations and non-governmental organisations. Their analysis shows that skilful and principled diplomacy can become a crucial part of a holistic approach to human rights protection, complementing other means such as legal remedies, public advocacy, political pressure and technical assistance. This book builds on discussions at a high-level workshop on the topic, organised by the University of Nottingham Human Rights Law Centre, the European Inter-University Centre for Human Rights and Democratisation and the Adam Mickiewicz University of Poznan'.

INTRODUCTION: Kate Parlett's study of the individual in the international legal system examines the way in which individuals have come to have a certain status in international law, from the first treaties conferring rights and capacities on individuals through to the present day. The analysis cuts across fields including human rights law, international investment law, international claims processes, humanitarian law and international criminal law in order to draw conclusions about structural change in the international legal system. By engaging with much new literature on non-state actors in international law, she seeks to dispel myths about state-centrism and the direction in which the international legal system continues to evolve.

INTRODUCTION: Comprehensive article-by-article analysis of the two most important documents in international refugee law.

Thematic chapters analyse general issues in internation refugee law.

Analysis of national legislation and practise on the Refugee Convention and its Protocol, making the Commentary indispensable for both international and national practitioners working on refugee cases.

Contributions from over 40 highly respected authors with both an academic and a practitioner background.

The Convention Relating to the Status of Refugees adopted on 28 July 1951 in Geneva provides the most comprehensive codification of the rights of refugees yet attempted. Consolidating previous international instruments relating to refugees, the 1951 Convention with its 1967 Protocol marks a cornerstone in the development of international refugee law. At present, there are 144 States Parties to one or both of these instruments, expressing a worldwide consensus on the definition of the term refugee and the fundamental rights to be granted to refugees. These facts demonstrate and underline the extraordinary significance of these instruments as the indispensable legal basis of international refugee law.

This Commentary provides for a systematic and comprehensive analysis of the 1951 Convention and the 1967 Protocol on an article-by-article basis, exposing the interrelationship between the different articles and discussing the latest developments in international refugee law. In addition, several thematic contributions analyse questions of international refugee law which are of general significance, such as regional developments and the relationship between refugee law and the law of the sea.

INTRODUCTION: Abstract:.

Focusing on seasonal agricultural migrant workers in Canada, this article illustrates how local migrant rights activists have utilized different judicial fora to claim rights for non-citizen migrant workers under the international human rights framework. The article underscores the role of litigation by activists who, citing international norms and conventions, claim that protections provided by domestic constitutional provisions and labor laws should be extended to non-citizen migrants. The importance of judges' willingness to recognize the international law framework is also underscored. This article contributes to human rights studies by emphasizing the transformative role of judicial agency in the fight for the extension of human rights protections.

Relative to citizens, non-citizens are a group lacking in political power and as such vulnerable to having their interests overlooked and their rights to equal concern and respect violated.

INTRODUCTION: Concerns associated with globalisation of markets, exacerbated by the 'credit crunch', have placed pressure on many nation states to make their labour markets more 'flexible'. In so doing, many states have sought to reduce labour standards and to diminish the influence of trade unions as the advocates of such standards. One response to this development, both nationally and internationally, has been to emphasise that workers' rights are fundamental human rights. This collection of essays examines whether this is an appropriate or effective strategy.

The book begins by considering the translation of human rights discourse into labour standards, namely how theory might be put into practice. The remainder of the book tests hypotheses posited in the first chapter and is divided into three parts. The first part investigates, through a number of national case studies, how, in practice, workers' rights are treated as human rights in the domestic legal context. These ten chapters cover African, American, Asian, European, and Pacific countries. The second part consists of essays which analyse the operation of regional or international systems for human rights promotion, and their particular relevance to the treatment of workers' rights as human rights. The final part consists of chapters which explore regulatory alternatives to the traditional use of human rights law. The book concludes by considering the merits of various regulatory approaches.

INTRODUCTION: ‘This Handbook will quickly become the first stop for all interested in human rights, whether they are academics, activists or civil servants. It provides a clear and accessible guide to international human rights law, but never sacrifices sophistication for simplicity. The authors cover a great range of human rights issues in an imaginative way and alert the reader to the major debates and controversies. This is a valuable contribution to the international protection of human rights.’ – Hilary Charlesworth, The Australian National University, Australia ‘The advance of global human rights is a kind of miracle. This book furthers the enterprise with a collection of cutting edge chapters on the legal issues of the second half of the 20th century. Those who want to stay ahead in this adventure in the 21st century will need to know the challenges that appear on every page.’ – The Hon. Michael Kirby AC CMG, Former Judge of the High Court of Australia 1996–2009 This innovative and timely Handbook brings together the work of 25 leading human rights scholars from all over the world to consider a broad range of human rights topics.

The book discusses a wide range of contemporary themes, for example jurisdictional issues, such as human rights in the private sphere and extra-territorial obligations. It also deals with global and regional human rights systems, intersections with other areas of international law and practice, such as international criminal law and globalisation, and specific human rights topics including terrorism and indigenous peoples.

Providing an excellent grounding for scholars seeking to understand the major topics within the discipline, this topical book is accessible to the novice human rights scholar, yet of great interest to the most seasoned human rights researcher. It will strongly appeal to law academics as well as students and practitioners of human rights.

INTRODUCTION: This book revisits, in a new light, some of the classic cases which constitute the foundations of the EU legal order and is timed to celebrate the 50th anniversary of the Rome Treaty establishing a European Economic Community. Its broader purpose, however, is to discuss the future of the EU legal order by examining, from a variety of different perspectives, the most important judgments of the ECJ which established the foundations of the EU legal order. The tone is neither necessarily celebratory nor critical, but relies on the viewpoint of the distinguished line-up of contributors - drawn from among former and current members of the Court (the view from within), scholars from other disciplines or lawyers from other legal orders (the view from outside), and two different generations of EU legal scholars (the classics revisit the classics and a view from the future). Each of these groups will provide a different perspective on the same set of selected judgments. In each short essay, questions such as 'what would have EU law been without this judgment of the Court? what factors might have influenced it?; did the judgment create expectations which were not fully fulfilled?' and so on, are posed and answered. The result is a profound, wide-ranging and fresh examination of the 'founding cases' of EU law.

INTRODUCTION: This volume offers a lawyer’s view on the meaning of fundamental social rights in today’s Europe. It is published on the occasion of the 10th anniversary of the EWL and reflects the research efforts the members of the European Working Group on Labour Law have made in its 10 years of existence.

The recognition of fundamental social rights offers opportunities for valuing the meaning of the fundamental social rights for workers aiming at actually benefiting from these. The non-discrimination norm, since it has been long and widely recognised in EU law, is the most striking example. It has served as a catalyst for all Member States. Apart from that, the fundamental social rights as generally recognised by international organisations are also challenged in EU law. This is not only because the EU law does not explicitly grant protection to workers since some of these fundamental social rights are not covered by it, but also due to a potential collision between these rights and the fundamental freedoms of the European Community. The recent cases of Viking, Laval and Rüffert appear to deliver conclusive proof of the potential subordination of the fundamental social rights to the fundamental freedoms of the EC.

In this volume, experts in the field of European labour law, deal with the opportunities EU law is offering and how it is fitting into the social policy of the European Union, as well as with potential threats to an effective application of the fundamental social rights. Some of the contributions refer to the cases of Viking, Laval and Rüffert as to their impact on the right to collective action as well as its meaning for the establishment of decent employment conditions, and in particular the right to a decent wage which is one of the ‘oldest’ fundamental social rights. Another crucial issue that is touched upon in this volume is the right to work and the right of protection for workers. The objective that is advocated in the EU as a cornerstone of modern social policy is the combination of flexibility and security, in one word: flexicurity, which has been analysed in terms of contributing to or jeopardising the position of the employee. It is the supposed dilemma of the protection of the ‘haves’ at the expense of the ‘have nots’, ‘insiders versus outsiders’. A third topic is the fundamental right connected to the freedom of association. A problem that has recently raised a lot of discussion and legislative proposals is whether sufficient representativeness of trade unions is required in order to be legitimised for collective bargaining and the conclusion of binding collective agreements. Linked to this is the effective recognition of the right of participation for workers and their representatives at enterprise level: the right to information and consultation, its scope and its effect.

What these contributions have in common is the question whether European law has to play a harmonising or only a facilitating role. Can or must the European Union contribute to the upgrading of the meaning and the impact of fundamental social rights in the labour law of the EU and its Member States, and if so, to what extent and in which way?

Contributions by Saskia Klosse, Antonio Lo Faro, Norbert Olszak, Jens M. Schubert, Fernando Valdés Dal-Ré and Charlotte Villiers.

INTRODUCTION: Highly analytical and original work on a rapidly evolving area of law, shaping the discussion at a time when new policy responses are considered by governments, the United Nations, and the industry itself Contributions by experts from the industry, providing key insights into the theory and the practice of the privatization of public functions Discussion of each relevant industry feed into an analysis of the limits of outsourcing public functions Private actors are increasingly taking on roles traditionally arrogated to the state. Both in the industrialized North and the developing South, functions essential to external and internal security and to the satisfaction of basic human needs are routinely contracted out to non-state agents. In the area of privatization of security functions, attention by academics and policy makers tends to focus on the activities of private military and security companies, especially in the context of armed conflicts, and their impact on human rights and post-conflict stability and reconstruction. The first edited volume emerging from New York University School of Law's Institute for International Justice project on private military and security companies, From Mercenaries to Market: The Rise and Regulation of Private Military Companies broadened this debate to situate the private military phenomenon in the context of moves towards the regulation of activities through market and non-market mechanisms.

Where that first volume looked at the emerging market for use of force, this second volume looks at the transformations in the nature of state authority. Drawing on insights from work on privatization, regulation, and accountability in the emerging field of global administrative law, the book examines private military and security companies through the wider lens of private actors performing public functions. In the past two decades, the responsibilities delegated to such actors - especially but not only in the United States - have grown exponentially. The central question of this volume is whether there should be any limits on government capacity to outsource traditionally "public" functions. Can and should a government put out to private tender the fulfilment of military, intelligence, and prison services? Can and should it transfer control of utilities essential to life, such as the supply of water? This discussion incorporates numerous perspectives on regulatory and governance issues in the private provision of public functions, but focuses primarily on private actors offering services that impact the fundamental rights of the affected population.

Readership: Scholars of international and public law, political theorists, post-graduate students, practitioners, policy-makers and regulators involved in the privatization of public functions.

INTRODUCTION: Description:.

Provides a critical analysis of the substantive content of each of the basic rights of the European Convention on Human Rights and successive Protocols.

The content and scope of each article is analysed with the most thorough exploration of the case law of the European Court of Human Rights contained in any textbook.

Contains a thorough account of the organisation and functioning of the European Court of Human Rights and the procedure for taking a case to Strasbourg, of value to students and practitioners alike.

New to this edition:.

Fully revised and updated to take into account the enormous amounts of new jurisprudence issued since publication of the first edition in 1995. The European Convention on Human Rights has changed radically since the publication of the first edition and the text has been updated to take these changes into account, including consideration of the impact of the admission of new member states from the Eastern bloc, the reforms in the working of the European Court of Human Rights and the huge increase in the volume of the Court's case law.

The first edition of Harris, O'Boyle and Warbrick: Law of the European Convention on Human Rights swiftly established itself as a seminal legal textbook. The eagerly awaited second edition builds on the great strengths of the first, and is an indispensible text for all undergraduates, postgraduates and practitioners. Its publication coincides with the 50th anniversary of the European Court of Human Rights, a major milestone in European legal history.

An up-to-date and comprehensive account of Strasbourg case law and its underlying principles, this book facilitates an in-depth understanding of this fascinating area of law. It fully explores the extent of the Convention's influence upon the legal development of the contracting states, and reveals exactly how such a powerful authority has been achieved and maintained. It sets out and critically analyses each Convention article that constitutes the substantive guarantee, and examines the system of supervision.

The Convention currently binds 47 European states, and its reach is set to expand even further. It has effectively become the constitutional bill of rights for Europe, providing common human rights standards for the whole continent. National parliaments and courts must constantly look to the Convention when legislating and deciding cases, or run the risk of adverse Strasbourg judgments with which they must then comply. For nearly all states, the Convention has been made directly enforceable in their national courts. For the remaining few, it offers a model for a national bill of rights. All of these considerations underline the immense value of the comprehensive account of the law of the Convention that this book provides.
