ABSTRACT: Editor's note: This report is an updated and short version of the report by Human Rights Watch/Helsinki `The Fall of Srebrenica And The Failure of U.N. Peacekeeping', which was written on the basis of fact-finding missions in Bosnia-Herzegovina performed by staff of Human Rights Watch/Helsinki. The report was published in October 1995. The full report can be obtained at the office of Human Rights Watch/Helsinki. The fall of the town of Srebrenica and its environs to Serb forces in early July 1995 made a mockery of the international community's professed commitment to safeguard regions it declared to be `safe areas' and placed under United Nations (un) protection in 1993. Un peacekeeping officials were unwilling to heed requests for support from their own forces stationed within the enclave, thus allowing Serb forces easily to overrun it and - without interference from un soldiers - to carry out systematic, mass executions of hundreds, possibly thousands, of civilian men and boys and to terrorize, rape, beat, execute, rob and otherwise abuse civilians being deported from the area. The Dayton peace-plan, and the guarded optimism that has accompanied this apparent progress, should not obscure the fact that no peace agreement will be legitimate or stable without justice for human rights abuses. The atrocities described in this piece, like the many others that have preceded them in the former Yugoslavia, require of the international community - and specifically the us - a commitment to reparation for the victims and accountability for the perpetrators. Before the war, approximately 37,000 people - 72.5 percent Muslims [1] and 25.5 percent Serbs - lived in the Srebrenica municipality. When Bosnian Serb forces - with the help of the Yugoslav People's Army (jna) - began their brutal campaign of `ethnic cleansing' in eastern Bosnia-Hercegovina in April and May 1992, most areas quickly fell under Bosnian Serb control. Most of the non-Serb men either fled, were put into detention centres, or were indiscriminately killed. Thousands of mostly Muslim refugees from other areas of eastern Bosnia flocked to places like Zepa, Gorazde and Srebrenica, where territorial defense units had succeeded in fending off Serbian attacks. As a result of this sudden demographic shift, Srebrenica's population swelled to an estimated 55,000 to 60,000, and remained under siege for more than three years. ..

ABSTRACT: I. Introduction The agreements which put an end to the bloodiest war fought in Europe since the Second World War are, in many respects, akin to other treaties which settled serious political and military crises. The Camp David Agreements of 17 September 1978 and the Peace Treaty between Israel and Egypt of 26 March 1979, in particular, come to mind, especially considering the rôle played in both by the United States Administration in attaining peace. However, the Dayton agreements are characterized by some unique legal features, which reflect the complexity of the peace process in the former Yugoslavia. This paper intends to discuss briefly the original and unusual aspects of the agreements from the point of view of international law. I shall classify these aspects under the following headings: (1) the law of treaties; (2) the international personality of de facto governments; (3) the State's constitutional organization. Before such examination I shall however briefly dwell on some general traits of the agreements.

ABSTRACT: The Peace Agreement signed in Paris on 14 December 19951 and the International Criminal Tribunal for the former Yugoslavia ("the Tribunal"), share a common purpose: the restoration of peace in the former Yugoslavia.2 The former aims to be a `comprehensive settlement'3 to the conflict in the region, addressing such diverse issues as demilitarization, elections, constitutional arrangements and human rights, and the latter is incorporated in its provisions as one aspect of that settlement. The Tribunal does not, however, loom large in the Peace Agreement. It is not, for example, explicitly mentioned in the "General Framework Agreement for Peace in Bosnia and Herzegovina" - the basic text of the Agreement - but only in the Annexes attached thereto. Several articles in the Annexes do refer specifically to the Tribunal, reaffirming the Parties' duty to co-operate with it and to comply with its orders. This is significant, not least because it is the first occasion since the London Agreement4 which established the International Military Tribunal at Nuremberg that a treaty has endorsed an international tribunal to try crimes against humanity and war crimes.5 Nevertheless the Peace Agreement's marginalisation of the Tribunal is in stark contrast to the pivotal rôle assigned to it by the Security Council, which has noted that `compliance with the requests and orders of the International Tribunal for the former Yugoslavia constitutes an essential aspect of implementing the Peace Agreement.'6 There is therefore a discrepancy between the Agreement's text and its implementation regarding the prominence to be granted to the Tribunal. The Agreement's text, for the most part, simply affirms and elaborates the Parties' duty to co-operate with the Tribunal and to comply with its orders; a duty under which Security Council resolution 827(1993)7 and Article 29 of the Tribunal's Statute already placed both States and de facto governments.8 The Agreement stops short of requiring co-operation from the international implementing force ("IFOR"). While the IFOR may have the authority, as discussed below, to arrest suspects and deliver them to The Hague, it is a moot point whether it will in fact do so.

ABSTRACT: The forthcoming trial of Dusko Tadic, the Bosnian Serb charged with violating international humanitarian law, including genocide, grave breaches of the Fourth Geneva Convention, and crimes against humanity, is likely to be foundational, political and epic.2 Like the Nuremberg and Tokyo trials, the trial of the first defendant in the custody of the new ad hoc war crimes tribunal for the former Yugoslavia3 is foundational in that it seeks not only to effect legal justice for Tadic but to reinvigorate the Nuremberg principles, and indirectly, the rule of law. It is political insofar as intended to deter future war crimes, make reconciliation possible in the former Yugoslavia, and help restore peace. It is epic since, beyond Tadic's guilt or innocence, what is at stake is the Security Council's power to direct the first international criminal proceedings since World War II through ad hoc tribunals created by Council fiat.4 Even before the trial of Tadic begins, its likely legacies are emerging, thanks to pre-trial defense motions challenging (1) the legality of the establishment of the Tribunal, (2) its primacy over national courts, and (3) its subject matter jurisdiction. This comment focuses on the trial and appellate chambers' responses to the first two sets of defense arguments.5 In these decisions, issued in August and October 1996 respectively, the Tribunal's judges attempt to justify their Tribunal's existence.6 Although, predictably, both trial and appellate chambers affirm the legality of Tadic's prosecution by the Tribunal, the legal arguments used to reach this result -- compromised from the outset -- are, by themselves, not sufficient to legitimize a Tribunal with such foundational, political and epic goals.
