Beck, 1993. - ISSN 0938-5428 LANGUAGE: ENG ABSTRACT: Many recent activities of the United Nations Security Council have been carried out in the shadow of legal doubts.2 A prominent and disturbing example of apparently activist Security Council action is found in measures taken against Libya due to its alleged involvement in the bombing of a Pan Am flight over Lockerbie in Scotland in 1988. On 21 January 1992 the Security Council passed Resolution 731 which inter alia obliged Libya to extradite two suspected perpetrators of the crime to either the United States or the United Kingdom for trial in one of those countries. In response Libya brought an action before the International Court of Justice (ICJ) and requested the Court to indicate provisional measures to enjoin the United States from taking coercive actions against Libya and to ensure that no steps were taken that would prejudice Libyas's rights. Unfortunately, any opportunity for the ICJ to make an independent ruling was thwarted by a Security Council decision. On 31 March 1992, three days after the close of oral hearings but before the ICJ brought down its judgment, the Security Council passed Resolution 748 ordering sanctions against Libya. The sanctions were to come into effect on 14 April, one day before a decision of the Court was due. INDEX WORDS:

Introduction On 13 September 1993 the Government of Israel and PLO representatives signed the `Declaration of Principles on Interim Self-Government Arrangements'.2 The Declaration was preceded by an exchange of letters between PLO Chairman, Yasser Arafat, and Israel's Prime Minister, Yitzhak Rabin on 9 September 1993. The letters and the Declaration set the stage for the settlement of the Israeli-Palestinian conflict. Indeed, since this conflict has been at the heart of a wider confrontation between Israel and the Arab world,3 these instruments may pave the way for peace in the Middle East. These documents, however, are only the beginning of a long and difficult process of reconciliation. Heavy stumbling blocks are yet to be negotiated away. Under these circumstances, one would expect the Declaration to be ambiguous and vague. And indeed it is. In this article I shall describe what has been achieved, seeking to point out the ambiguities and their possible interpretations. I shall also outline the major difficulties that lie ahead. On 22 February 1991 Portugal submitted an application to the International Court of Justice (ICJ) instituting proceedings against the Commonwealth of Australia. Portugal was acting on behalf of, and in the interest of, the people of East Timor in bringing the claim, while simultaneously defending its own interests. In 1989 Australia concluded an agreement with Indonesia concerning the delimitation and the exploitation of the continental shelf of East Timor.
